ایران: ناقض حقوق بشر را از هیات سازمان ملل اخراج کنید
حضور متهم به شکنجه، در جلسه شورای حقوق بشر سازمان ملل
(نیویورک، ٢٢ ژوئن ٢٠٠٦)- سازمان دیده بان حقوق بشرامروز گزارش داد که ایران باید فورا دادستان کل بدنام تهران را از هیاتی که برای شرکت درجلسه شورای حقوق بشربه ژنو فرستاده است، خارج کند. سعید مرتضوی، دادستان کل تهران در شکنجه، بازداشت غیرقانونی ووادارکردن به اعترافات غیرقانونی بسیاری از زندانیان سابق دست داشته است.
جواستورک، معاون بخش خاورمیانه وشمال آفریقای سازمان دیده بان حقوق بشر درهمین زمینه گفت: "تصمیم ایران برای فرستادن مرتضوی به ژنو، اهانت به حقوق بشر و تحقیرشورای تازه تاسیس حقوق بشر است." به گفته وی ایران حالا متوجه می شود که چرا اعضای سازمان ملل از انتخاب این کشور به عضویت درشورای حقوق بشر این سازمان سرباززده اند.
مرتضوی، در آوریل ٢٠٠٠ ودرزمانی که به عنوان قاضی شعبه ١٤١٠ دادگاه عمومی مشغول به کاربود، هدایت سرکوب شدید ناراضیان سیاسی را به منظور ساکت کردنشان به عهده داشت. او دستور تعطیلی بیش از ١٠٠ روزنامه ومجله را داده است. در سال ٢٠٠٣، او به مقام داستان کل تهران ارتقاء مقام یافت. در سال ٢٠٠٢، یکی از کارشناسانی که از سوی کمیسیون حقوق بشر سازمان ملل برای نظارت بر وضعیت حقوق بشر در ایران به ایران سفر کرد، در اقدامی فوق العاده از سعید مرتضوی در گزارش خودبه آشکارا نام برد وخواستار تعلیق او از کارخود شد.
زهرا کاظمی روزنامه نگار-عکاس ایرانی-کانادایی نیز درماه ژوئن سال ٢٠٠٣ هنگامی که در بازداشت ماموران امنیتی وقضایی تحت کنترل سعید مرتضوی بود کشته شد. وکلایی که وکالت این پرونده را به عهده دارند اظهار کرده اند که در بدن او آثار شکنجه، ازجمله ضربه به سروی دیده می شود. به گفته آنان مرتضوی مستقیما در بازجویی کاظمی حضور داشته است.
درسال ٢٠٠٤، مرتضوی رهبری بازداشت بیش از بیست روزنامه نگاراینترنتی و وب لاگ نویس را به عهده داشت. این افراد توسط وی در زندان های محرمانه نگهداری می شدند. سازمان دیده بان حقوق بشر شهادت چندین تن از این زندانیان را جمع آوری کرده که می گویند مرتضوی دربازداشت آنها که بیشتر در سلول های انفرادی بود و تهدید برای اعتراف های تلویزیونی اجباری دخالت مستقیم داشته است.
"جو استورک" گفت:" ایران به جای اینکه مرتضوی را به دستان عدالت بسپرد به ژنو آورده است. این تصمیم مرتضوی را تبدیل میکند به سمبل مصونیت فراگیری که برای مقامات متهم به نقض حقوق بشر درایران وجود دارد.
سازمان دیده بان حقوق بشر از ایران می خواهد که مرتضوی را به خصوص در مورد موضوع شکنجه مورد بازخواست قرار دهد واز کاربرکنار کند. اعضای شرکت کننده دولت ها درجلسه شورای حقوق بشر نیز باید خواستار برکناری او از شورای ایران شوند وهمچنین مادامی که مرتضوی در هیات ایرانی حضور دارد باید ازملاقات با هیات ایرانی خودداری کنند.
تمام اعضای دولت های عضو سازمان ملل برای فرستادن نمایندگانی به منظور صحبت کردن هنگام اولین هفته شورای حقوق بشر دعوت شدند که ماه گذشته به جای کمیسیون پیشین ایجاد شد. طبق برنامه ریزی انجام شده نمایندگان بیش از ١٠٠کشور در این شورا سخنرانی خواهند داد.

Iran: Remove Rights Abuser From Delegation at U.N.
Accused Torturer at Human Rights Council Session
(New York, June 22, 2006) – Iran should immediately remove Tehran’s notoriously abusive prosecutor general from its delegation to the U.N. Human Rights Council in Geneva, Human Rights Watch said today. The prosecutor general, Saeed Mortazavi has been implicated in torture, illegal detention, and coercing false confessions by numerous former prisoners.
“Iran’s decision to send Mortazavi to Geneva demonstrates utter contempt for human rights and for the new council,” said Joe Stork deputy director of Middle East and North Africa division for Human Rights Watch. “Iran has just confirmed why U.N. members refused to elect it to the Human Rights Council.”
In April 2000, Mortazavi, then the judge of Public Court Branch 1410, led a massive crackdown to silence growing dissent in Iran. He ordered the closure of more than 100 newspapers and journals. In 2003, he was promoted to the post of Tehran’s prosecutor general. In 2002, a human rights expert appointed by the old U.N. Commission on Human Rights to monitor the human rights situation in Iran took the extraordinary step of naming Mortazavi publicly in his report and calling for him to be suspended from the bench.
Iranian-Canadian photojournalist Zahra Kazemi died in June 2003 while in the custody of judiciary and security agents led by Mortazavi. Lawyers representing Kazemi’s family have alleged that her body showed signs of torture, including blows to her head, and that Mortazavi participated directly in her interrogation.
In 2004, Mortazavi orchestrated the arbitrary detention of more than 20 webloggers and internet journalists, who were held in secret prisons. Human Rights Watch collected testimonies from several of these detainees who implicated Mortazavi in their ordeal, which included lengthy solitary confinement and coercion to make false televised confessions.
“Iran has brought Mortazavi to Geneva instead of bringing him to justice,” Stork said. “This decision should make Mortazavi the poster child for rampant impunity in Iran.”
Human Rights Watch urged Iran to hold Mortazavi to account in particular for the allegations of torture, and to remove him from office. Governments participating in the Human Rights Council session should seek Mortazavi’s removal from the Iranian delegation, Human Rights Watch said, and should refuse to meet with the delegation while Mortazavi remains a member.
All U.N. member states were invited to send representatives to speak during this first week of the Human Rights Council, which was created last month to replace the old commission. More than 100 countries are scheduled to address the body.
